If the ATO is pursuing you for a tax debt, they may use a number of ways to recover the debt. In some cases, a garnishee order may be issued to your bank, employer or trade debtor, legally obliging them them to pay (any money they owe you) directly to the ATO. Increasingly, the ATO have been issuing a Statement of Claim, which is an application to the Court to obtain a judgement order confirming that the debt is owing. That judgment is then used to wind up your company or force you into bankruptcy. These debts do not need to ruin your life and can be negotiated to achieve a fair outcome.
