Arbitration & Conciliation are more formal methods of Alternative Dispute Resolution (ADR). Arbitration is similar to presenting your case in the courtroom in that both parties are given the opportunity to provide their side of the story to an arbitrator, an independent third person. The arbitrator will then make a decision that may be binding on both parties. Conciliation sits between Mediation and Arbitration – the independent party does not make a decision on the matter however may suggest resolution options to the parties.
