It is well known that the Australian Taxation Office will move quickly to impose a Director Penalty Notice on the director of a company that has outstanding lodgement and payment breaches for PAYG, GST and the Superannuation Guarantee Charge. Director Penalty Notices are a serious matter. There are two types of Director Penalty Notices, lock down and non-lockdown, each with their own issues and consequences. Advice should be sought immediately to prevent further action against the director as the ATO will proceed to take all necessary steps, including bankruptcy, to recover the debt. Often, the ATO will target the family home as an easy source of payment, so it is important to act quickly because the time limits are rigid and have serious consequences.
