We recently acted on behalf of a mother of an injured child who sustained an injury requiring major surgery after the child fell from a children's slide in a day care centre.
We argued that the day care centre staff were negligent in that they failed to properly supervise the playground when the child was pushed by another child off the equipment. The risk of injury was foreseeable and the injury could have been prevented simply by preventing children pushing and misbehaving on the slide.
The playground staff owed the child a duty of care and had breached their duty of care in the above circumstances.
The child received damages for her injury including general damages for pain and suffering, damages for medical treatment and for gratuitous care provided by her mother after the injury.
